Before signing up for a workshop, students must agree to the terms and conditions, as they are stated below. If you have any questions, please feel free to contact me at chuckplace@cox.net and I will be happy to answer them.

SUPPLIES

I understand that no materials, including a camera will be provided. I understand that I am responsible for bringing any and all equipment necessary for the Workshop.

LIABILITY

I agree that Santa Barbara Photographic Workshops or any of its officers are not responsible for any injury, loss, theft or damage to me or my property, arising out of or pertaining to preparation for or participation in the lesson, whether such injury, theft, or damage occurred prior, during, or after the lesson.

I understand and agree that I am SOLELY responsible for any loss, stolen or damaged property I bring with me.

I agree to indemnify, defend and hold harmless Santa Barbara Photographic Workshops, or any of its officers, for and against any claims for such injury, loss, theft or damage related to the lesson.

CANCELLATIONS

I understand student cancellations two weeks or more before the workshop start date will receive a full refund. Cancellations between one and two weeks before the start date will receive a 50% refund and there will be no refunds for cancellations the week before the workshop start date.

I also understand that if the instructor needs to cancel a workshop or reschedule a workshop due to an unforeseen emergency or weather issue, either credit will be given for the next workshop, reschedule at a time agreeable to both parties or any paid amount will be fully refunded.

OBLIGATIONS OF THE INSTRUCTOR

I understand and agree that the Instructor will undertake to:

1. Do all preparation prior to workshops and to structure lessons in such a way as to optimize time to the benefit of the Student.

2. Provide information on all the topics stated in the workshop description (as seen on the website)

3. Consistently make sure that everyone in the workshop is following material and provide personal assistance if any student needs additional help with the settings of their camera.

4. Keep confidential all information of the Student.

I agree that the instructor shall not assign any of his/her duties or obligations under this teaching agreement to a third party without notice to the Student.

OBLIGATIONS OF THE STUDENT

I agree to:

1. Arrive on time.

2. Respect other students by not talking while the teacher or anyone asking a question is talking.

3. Assist the Instructor in identifying problem areas in which the Student needs specific teaching.

NO WARRANTIES

I understand that the workshops given through Santa Barbara Photographic Workshops will NOT result in a professional photographer’s certification or provide the skills to equal that of which a professional photographer is required.

I understand that Santa Barbara Photographic Workshops makes no promises or warranties with regard to a Student’s photographic skill or performance as a result of any teaching provided.

I understand and agree that Santa Barbara Photographic Workshops will provide information on the topics stated in the workshop descriptions but it will be up to me to practice in order for my photographic skills to improve.

OWNERSHIP/COPYRIGHT

I understand that I will have the complete rights to my photographs. Instructor must receive permission from the student for the use any of their images to promote Santa Barbara Photographic Workshops in any way.

INSURANCE

I understand and agree that I am responsible to provide any insurance for my equipment, artwork, or any other property. I understand that it is strongly recommended to carry my own general liability and product liability insurance for the time of the lesson, as Santa Barbara Photographic Workshopsdoes not provide this coverage and is not responsible for any damages.

RELAXATION OF TERMS

I understand that any relaxation, indulgence, waiver or release by any party of any of the rights in terms of this agreement in one occasion shall prevent the subsequent enforcement of such rights and shall not be deemed to be a waiver of any subsequent breach of any of the terms.

WHOLE AGREEMENT

I agree and understand that this agreement constitutes the entire understanding between myself and Santa Barbara Photographic Workshops with regard to the subject matter thereof and the parties waive the right to rely on any alleged, expressed or implied provision not contained herein. I agree that any alteration to this agreement must be in writing and signed by both parties.
